a. The PizzaPass is valid for one year from the date of purchase.
3. Pizza Entitlement:
a. The PizzaPass entitles the holder to one restaurant-specified pizza per week for 52 weeks.
Redemption
1. Weekly Redemption: Each week, you will receive a single-use redemption code via email to order and pick up your weekly pizza. Unused weekly pizzas do not roll over to subsequent weeks.
2. Redemption Process: To redeem your weekly pizza, click the "Order Online" button provided in your email, enter your redemption code, and choose your 12" medium cheese or pepperoni pizza.
3. Gift Option: You may pass the redemption code to someone as a gift, but it can only be used once and must be used within the designated week.
4. Delivery: Delivery is available for a fee through DoorDash Drive for up to 5 miles.
5. Additional Options: You can add extra toppings or upsize your pizza for a minimal cost at menu price.
Subscription Benefits
1. Cost Savings: Subscribers save $791 over the year, enjoying each pizza at just $3.79.
2. Weekly Convenience: Enjoy a fresh pizza every week without the hassle of ordering each time.
3. Customization: Customize your pizza with additional toppings or size upgrades for a minimal additional cost..
Limitations and Exclusions
1. Additional Toppings and Upgrades: Any additional toppings, upgrades, or specialty pizzas are not included and will be charged at regular prices.
2. Non-Redeemable for Cash: The PizzaPass cannot be redeemed for cash or any other form of credit.
3. Lost or Stolen Codes: Brewability is not responsible for lost or stolen redemption codes.
Cancellation and Refunds
1. Cancellation Policy: Generally, the PizzaPass is non-refundable once purchased. However, if you've redeemed four or fewer pizzas and within 30 days of purchase, a refund could be provided after prorating the number of pizzas consumed using the PizzaPass at the retail price. All refunds are subject to a 10% subscription platform fee and 3.5% payment processing fee.
2. Termination by Brewability: Brewability reserves the right to terminate any PizzaPass without notice if any fraudulent activity or misuse of the pass is detected.
Privacy and Data Use
1. Personal Information: By subscribing to the PizzaPass, you agree that Brewability may collect and use your personal information for the purpose of administering the program and for marketing communications.
2. Marketing Communications: By providing your email address and phone number, you consent to receive email and SMS marketing communications, including order notifications and promotional messages, from Brewability.
3. Data Protection: Brewability will handle your personal information in accordance with its privacy policy.
Limitation of Liability
To the maximum extent permitted by law, Brewability shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the PizzaPass.
Dispute Resolution
Any disputes arising out of or relating to these terms and conditions or the PizzaPass will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Any such arbitration shall take place in the state of California.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the state of California, without regard to its conflict of laws principles.
Changes to Terms and Conditions
Brewability reserves the right to modify these terms and conditions at any time. Any changes will be communicated to pass holders via email and will be effective immediately upon posting on the website.
